Terms of use

EFFECTIVE DATE: January 01, 2021

This Terms of Use outlines the user policy of Bytrix, its services and liabilities involving the use of our services and products. By registering for any of our services, you agree that you have read and accepted all the terms and conditions outlined in this document.

Coverage & scope

This Terms of Use covers the treatment of use of services and products BYTRIX and/or a website owned and operated by BYTRIX.

This document is not applicable to companies that BYTRIX has no ownership of or does not control, or of persons that are not under the employment and management of Bytrix, including any third-party service and/or product providers bound by contract and any third-party websites to which Bytrix’ website links.

Filing a complaint

In case of filing a complaint, BYTRIX will try and come to a mutually acceptable solution if a user is unsatisfied with any of our services. Revocation occurs when things don’t work out. If You think about filing a claim, please write to us before launching a request.

You should only file complaints if we are unable to affect a mutually satisfactory solution.

Eligibility for refund

We handle every project in a professional manner to ensure that the client is delivered what was mentioned as per the terms and conditions of the proposal. However, if the client has gone through the dispute resolution process, refund claims will be considered as per the following schedule which clearly lists the services and our Terms of Use related to each service.

Application programming

We will offer a full refund if, for some reason, the project has not been initiated. An agreement is drafted for every application programming project. In case no agreement has been devised and/or there is no mention of a Terms of Use, we will apply the following delivery policy:

BYTRIX will issue a partial refund upon the discretion of the service provider if the project does not get finalized as mentioned in the delivery policy and contract. The proportion of the project completed will be calculated by BYTRIX and the proportion that is not complete will be treated as per the pre-defined scope of the project.

Dedicated hiring

BYTRIX offers a full refund if there is a delay in starting the project by either the programmer / designer / content writer / SEO expert (or any other resource / staff).

We will offer a proportionate refund if the client cancels the project at any point in time.

We offer no refund for days worked. If the client is not satisfied with the work at any point in time, they must immediately notify our Project Manager and ask for discounts for any work not carried out. We will not accept any such negotiation at a later date.

Applicability of the delivery policy

Timely payments: A project is not considered to be void if the agreed upon / listed payments are not clear.

Timely communication from the client: BYTRIX is not bound by the Terms of Use. The client must provide timely information for successful completion of the project. BYTRIX will not accept any responsibility for the delay or failure of completing the project arising out of miscommunication or lack of communication in a timely manner.

Completeness of information provided by the client: BYTRIX is not obligated to respect its delivery and/or refund commitments if the client fails to provide complete information/scope of the project to BYTRIX at initializing stage of the project.

BYTRIX will only compensate for the delay of delivery, unless there is a special agreement signed with a penalty clause for delay in delivery.

Limitation of liability

Bytrix’ liability is limited in as much to the value of the portion of the project (as per Bytrix’ proposal) which may be incomplete at any given point of time. BYTRIX will not be held responsible for losses arising out of the services delivered / not delivered or the delay in the same. BYTRIX is only liable to refund if the client cancels the project, and as such, the cancellation has been communicated to BYTRIX in writing.

Processing of refunds

BYTRIX will process the refunds and mail the same within 5 business days of the cancellation date. The same method of payment will be required as the original (refund by check or refund to credit card).

Email & Mobile Phone Policy

This policy outlines the terms and conditions regarding the use of email and mobile phone contact information provided to Bytrix.

1. Consent and Usage

By providing your email address and/or mobile phone number, you consent to receive communication from Bytrix. This includes, transitional messages, periodic updates about your service or project, updates, newsletters, and services delivery e.g. Design attachments, Project updates and Revisions update.

2. Carrier Charges Disclosure

Standard messaging and data rates may apply. Please consult your mobile service carrier for details.

3. Stop & Unsubscribe

If you wish to stop receiving emails or mobile communications, you can:

  • For emails, click the "unsubscribe" link located at the bottom of any email you receive from us.
  • For mobile communications, reply "STOP" or “Unsub” “Unsubcribe” to any SMS message you receive from us. The SMS will will be stopped right away.

4. Frequency of Communication

We will strive to limit the frequency of our communications to a reasonable level. However, there may be exceptions during special update about project or urgent notifications.

5. Security of Information

Your email address and mobile phone number will be kept confidential and will not be shared with third parties without your explicit consent, except as required by law.

6. Changes to Policy

Bytrix reserves the right to modify this policy at any time. Any changes will be posted on our website, and it is your responsibility to review these changes.

SMS and Email Terms & Conditions

1. Overview

By subscribing to our SMS and email communication services, you agree to receive text messages and emails from Bytrix. These communications may include updates, promotional content, notifications, and other information related to our services. Your participation in these programs is subject to the following Terms & Conditions, in compliance with 10DLC TCR regulations for the US and Canada.

2. Opt-In Process

SMS Subscription: When you provide your mobile number on our website, you may receive a confirmation text message asking for your consent to subscribe to our SMS service. By replying to the confirmation message with the designated keyword (e.g., "YES"), you agree to opt in to receive SMS messages from Bytrix. Email Subscription: By providing your email address and selecting the option to receive communications from us, you consent to receiving emails related to our services, promotions, and updates.

3. Message Frequency

SMS: The number of SMS messages you receive may vary based on your communication requirements with our team. This allows us to provide timely updates and respond to your needs effectively. Email: Emails will be sent periodically and may vary in frequency depending on the type of communication and your preferences.

4. Opt-Out Process

SMS Opt-Out: You can opt out of our SMS communications at any time by replying to any of our messages with the word "STOP". Upon receipt of your opt-out request, we will send a confirmation message, and you will no longer receive SMS messages from us. Email Opt-Out: To unsubscribe from our email communications, click the "unsubscribe" link provided at the bottom of any email we send. You can also contact us directly at hello@bytrix.com to request removal from our email list.

5. Cost

SMS: Message and data rates may apply based on your mobile carrier plan. Please check with your carrier for details. Email: There is no charge for email communications.

We adhere to the rules and regulations set forth by the 10DLC TCR (The Campaign Registry) and comply with all relevant laws and guidelines for SMS and email marketing in the US and Canada. Your participation in our messaging programs is subject to these regulations.
